1. General Terms and Conditions
1.1. If you choose to use the Website and Website applications, including RSS, API, software and other files, you hereby grant your consent to comply with all of the terms and conditions set forth in these Website Terms of Use (hereinafter – the Terms), including by registering your personal account on the Website. These Terms shall constitute a legally binding service agreement between the user and the Company on the use of the Website and its services by the user.
1.2. We may change the terms and conditions set forth in these Terms at any time, and such changes shall become effective immediately after being published on the Website.
1.3. You shall be under the obligation to review these Terms before each use of the Website. If you continue to use the Website after we publish the modified Terms, this shall constitute your consent to abide by the Terms with all of the changes made hereto.
1.4. If any provision of these Terms or any change hereto is unacceptable to you, you may choose not to begin using the Website or to cancel your account in the manner specified in Section 8 of these Terms.
2. Website Content
2.1. The materials published on the Website are intended for your personal noncommercial use. All and any materials published on the Website, including but not limited to: news, photos, images, illustrations, audio and video clips (hereinafter - the Materials or the Content) are protected by copyright and are owned or controlled by the Company or the party which provides the Content. You undertake to abide by all and any additional copyright notice, information, or restriction set forth on any page of the Website.
2.2. The Website content is protected by copyright according to the laws of Ukraine and international copyright law. You may not modify, publish, transfer, participate in the transfer or sale thereof, reproduce (except as provided for by cl. 2.4 of these Terms), create new works, distribute, perform or in any manner exploit any of the Website content (including its software) in the entirety or partially.
2.3. Commercial (brand) names, trademarks, etc. of the Company or third parties are protected by copyright. Nothing specified in these Terms shall be construed as granting implicitly, by default or otherwise any license or right to use any trademark, patent, design rights or copyright of the Company or third parties.
2.4. You may download or copy the contents of the Website, other components and elements appearing on the Website only for your personal use, subject to all copyrights and other notifications contained therein. Copying or saving of any content for use otherwise than for personal use without the prior written consent of the Company shall be strictly prohibited.
2.5. Internet publications and mobile applications shall be allowed the free-of-charge use of the information published on the Website subject to open hyperlinks and references to the original source not below the first paragraph and not more than by fifteen hundred characters of the original text. A larger text may be used only subject to obtaining the Company’s written consent thereto.
For SmartTV, the Company’s materials may be used on a paid basis and only with the Company’s written consent. Other media may use the information published on the Company’s websites to the extent not exceeding fifteen thousand characters, subject to reference to the original source. The use of information shall mean any reproduction, republication, distribution, reworking, translation, incorporation of its parts into other works and other ways of use as prescribed by the Law of Ukraine "On Copyright and Related Rights".

3. User Content
3.1. You agree to use the Website only for a legitimate purpose and in the manner not infringing upon the rights of other users, not restricting and not preventing the access to and the use of the Website by others.
3.2. It shall not be allowed to upload, distribute and publish any content having any libelous, defamatory, obscene, pornographic or other illegal nature; advertising materials, commercial notifications and notifications conveying no information and having no relation to the subject matter of this resource.
3.3. Be polite. You agree that you will not threaten or insult other users by using defamation techniques or by deliberately posting messages with repeated content (spam). Please use respectful language. Online conversation will continue only if our users feel comfortable and safe. You agree not to use any language which is abusing or discriminating on the basis of race, religion, nationality, gender, sexual preferences, age, region, disability, etc. Hatred of any kind shall be the reason for immediate suspension of your access to the entire Website or part thereof.
3.4. Discuss, but don't attack. In a society full of opinions and preferences, people always have divergent views. The Website invites to active discussion and welcomes hot debate, but a personal attack shall be a direct violation of the Terms and shall be the reason for immediate suspension of your full or partial access to the entire Website.
3.5. In your messages do not disclose any personal information about yourself or anyone else (for example: telephone number, home address, email address).
3.6. You acknowledge that any material distributed by you (for example the content created by you, including but not limited to: comments, forum, messages, reviews, text, video, audio and photographs, as well as computer code and applications) may be removed or modified by us. You waive any right which you may have in case of presence of such a material on the Website, and the materials may be changed even if you disagree. Besides, the materials may be included into our RSS feeds, APIs and made available for republishing via other formats.
3.7. You shall grant the Company a perpetual, non-exclusive, worldwide, royalty-free license to the materials published/sent/distributed by you, and this shall also include the transfer to the Company or any third party the unrestricted right to use, copy, transmit, publish, distribute, create derivative works, change, and adapt the index, cache and tags, and also encoding (including, without limitation, the rights to adapt to stream downloading, broadcast, mobile or digital scanning, or other technologies) in any form or medium now known or hereafter developed, including any publication made by you on the Website or on the website owned by the Company.
3.8. You shall be solely responsible for the contents of your publications. The Company is unable to control each material and shall not be responsible for the contents of such notifications. We reserve the right to delete, transfer or edit any publication which the Company, in its sole discretion, may deem to be offensive, defamatory, indecent or unacceptable, or infringing upon any copyright and trademark.
3.9. You consent to the display of the material developed by you and its publication on the Website, as well as to the same for advertising purposes outside of the Website.
4. Warranties and Representations
4.1. You assure, warrant and represent that (a) the materials of any kind submitted via your account (I) shall not constitute an infringement or plagiarism and shall not infringe upon any third party right, including any copyright, trademark, privacy right, or other personal or proprietary rights, or (II) shall not contain any libel or other illegitimate material, and (b) that you are at least eighteen years old.
4.2. Hereby you warrant and represent that you shall indemnify, defend and hold harmless the Company and any of its officers, directors, owners, agents, information providers, affiliates, licensors and licensees against any and all liability and expenses, including legal costs, incurred in connection with any claim resulting from a breach of these Terms, warranties and agreements by you or any user of your account. The Company reserves the right, at its expense, to assume the exclusive defense and control of any matter which requires any compensation from you.
4.3. The Company shall not guarantee or confirm the accuracy or reliability of any advice, opinion, statement or other information uploaded or disseminated through accounts of any users, information providers or any other individuals or legal entities. You acknowledge and realize that if you rely on such an opinion, advice, statement, memorandum or any other information, this shall be solely at your own risk. The Website materials shall be distributed "as is", without a guarantee of any kind, including guarantees of the right of ownership or fitness for a particular purpose. Hereby you acknowledge that you shall use the Website at your own risk.
5. Registration and Security
5.1. As part of the registration or account creation process, you shall create account login data by selecting a password and providing an email address. You will also be required to give us certain information about yourself which should be accurate and updated.
5.2. Each registration is valid for one user. You may not share your registered account login data so that no one else can have access to your account. We may cancel or suspend your access to the Website if you share your account login data. 5.3. We welcome people of all ages on our Website, but we also have the intention of protecting children, and for this reason under-age persons do not have the opportunity to get registered on the Website.

9.1. These Terms shall apply in accordance with current law of Ukraine. Any dispute regarding the exercise of these Terms shall be resolved by a competent court according to the procedure established by current law of Ukraine.
